Interpretation
In these conditions (“Conditions”) “We”, “Us” or “Our” means QMH DRIVING SCHOOL and “You” or “Your” means the customer.
You must read these Conditions in full as they set out our complete Terms upon which we have agreed to provide, and you have agreed to Obtain, driving tuition from us. We and Your Instructor reserve the right to charge for any lessons affected by your failure to comply with any of these Conditions.
1. YOUR INSTRUCTOR AND QMH DRIVING SCHOOL
1.1 Your instructor is a self-employed franchisee (‘your instructor’) of QMH Driving School (‘QMH Driving School’, ‘we’, ‘us’, ‘our’)
1.2 No contractual liability shall arise or subsist between you and us; however we will endeavour to assist you with your requirement.
2. DRIVING LICENCES AND FITNESS TO DRIVE
2.1 You must hold a current, valid U.K driving licence, provisional, full or international, and produce it on (or in advance of) your first driving lesson. You must be fit to drive with regard to legal and medical requirements.
2.2 Your eyesight must be up to standard. If you are unable to read a number plate from the required distance, the instructor may refuse to allow you to drive. It is advisable to have your eyesight checked before beginning any course.
3. PROGRESS CARD
3.1 Your instructor will issue a progress card on your first lesson; pupils are advised to keep the card safe and must bring it with them to every lesson to enable an accurate record of future lessons and training already received.
3.2 You are responsible to keep an accurate record of lessons to ensure punctuality and to avoid mistakes being made.
4. YOUR INSTRUCTOR’S RESPONSIBILITIES
4.1 Your instructor will behave in a professional manner towards you, as per the Driver and Vehicle Standards Agency’s (DVSA) Code of Practice for Approved Driving Instructors.
4.2 Your instructor agrees to abide by the conditions of the Professional Code of Conduct (a copy of which will be provided on request).
4.3 Your instructor will be responsible to maintain his vehicle in a clean, roadworthy condition as required by law.
4.4 Your instructor will provide a vehicle fitted with dual-controls and learner driver livery.
5. INSURANCE
5.1 Your instructor will carry the appropriate motor insurance, should you be involved in a collision as a learner driver while in control of driving the instructor’s tuition vehicle.
5.2 Your instructor will provide a vehicle that is fully taxed and insured for tuition and practical driving test purposes.
6. LESSONS PRICES
6.1 First introductory offers are only available to complete new beginner learners, cannot be used in conjunction with other offers and are not transferable.
6.2 Prices are correct as of January 2021. Although we strive to remain competitive with our pricing, we reserve the right to alter the pricing structure without prior notice. Subsequent lesson prices will then be charged according to the new pricing structure. Any outstanding pre-paid lessons will be honoured at the original price paid.
6.3 Payment for tuition shall be made cash directly to the Instructor or bank transfer to the company’s account.
6.4 You must obtain a receipt as the QMH Driving School cannot accept responsibility for any payments to your Instructor.
6.5 Lessons will be on a one-to-one basis unless otherwise agreed by all parties concerned.
6.6 Duration of each lesson is 2 hours.
6.7 All the prices include weekends, evenings, weekdays and bank holidays.
6.8 Pay, as you take lesson prices, are £35.00 for a manual car and £35.00 for an automatic car, motorway or advanced driving lessons not included.
6.9 You must put your Invoice Reference Number or your name as Reference.
6.10 Once we have received your payment we will issue you a paid invoice.
6.11 You must obtain a receipt from the QMH Driving School, once you have made the payment to your driving instructor.
6.12 You must take lessons within 6 months of the purchase date. Out of that time period, the lessons will be lost and you will lose your right to have a refund.
7. INTENSIVE DRIVING COURSES
7.1 Intensive driving courses do not include the charges of the theory test, the hire of the car on the test day, or the practical driving test fee.
7.2 Intensive driving course must be taken within 6 months of the purchase date. Outwith that time period, the lessons will be lost.
7.3 All intensive driving course cancellations will have the balance refunded in full. As intensive driving course bookings incorporate a discount on the full lesson price, the monies returned on cancellation will be proportional to the amount paid.
7.4 If you are not in contact with the instructor for more than 6 weeks you will lose any advanced payments.
8. BLOCK BOOKINGS
8.1 Block booking lessons must be taken within 6 months of the purchase date. Outwith that time period, the lessons will be lost.
8.2 Block booking discounts are only valid when pay in advance and do not include a driving test fee or the hire of the car on the test day.
8.3 All block booking cancellations will have the balance refunded in full. As block bookings incorporate a discount on the full lesson price, the monies returned on cancellation will be proportional to the amount paid.
8.4 If you are not in contact with the instructor for more than 6 weeks you will lose any advanced payments.
9. PASS PLUS COURSE
9.1 Pass Plus course contains a minimum of 6 hours. Pass Plus certificate only applied when a minimum of 6 hours are completed.
10. TRAINING LOCATION
10.1 All sessions will start and finish at the same location unless alternative arrangements are made in advance. Your instructor will determine a location for practical lessons which ensures both your and public safety.
10.2 Until your instructor determines that your skill level enables you to drive safely from the starting location, this may mean that your instructor will drive you to a safe location. The time taken to do this will be part of the lesson time.
11. YOUR RESPONSIBILITIES
11.1 Angry and aggressive behavior will not be tolerated in the car at any time. Any such behavior will result in the lesson being stopped, and you being dropped off immediately. You will be charged for the full lesson.
11.2 If you are suspected of being under the influence of alcohol, illegal substances or drugs (prescribed or otherwise), whereby your judgment and responses may be impaired, you will be dropped off immediately. You will be charged for the full lesson and any prepaid lessons will not be refunded.
11.3 The instructor’s telephone number should be saved under ‘Driving Instructor’ to reduce the risk of inadvertent texting/calling.
11.4 If for any reason, you have to text your instructor, then all text communication should be easily understandable, without common text abbreviations and substitutes, and should be polite and formal in tone, as best fits the professional relationship between you and your instructor.
11.5 Any changes to pick-up/drop-off points should be arranged at least 24 hours prior to the lesson. Any extra travel time, to any such points, will be part of the lesson time.
11.6 If you require tuition in your own vehicle (e.g. Pass Plus/refresher lessons), you must supply evidence that your vehicle is fully taxed, MOT’d, and insured.
11.7 You are agreeing to refrain from smoking in the tuition vehicle at all times.
11.8 You are agreeing to refrain from consuming food or drink in the tuition vehicle without the prior consent of your Instructor.
11.9 You are agreeing that it is your responsibility to provide all relevant documentation required when taking your theory and practical driving tests. Neither The QMH Driving School nor your Instructor accepts any responsibility for any losses caused by failure to provide this documentation.
12. LATENESS
12.1 Your instructor will endeavor to be on time always. In the event of any lateness, your instructor will contact you to confirm the new start time.
12.2 If your instructor is going to be more than 20 minutes late you may opt to reschedule your lesson if necessary.
13. CANCELLATIONS POLICY
13.1 If you wish to cancel a lesson, a minimum of 48 hours prior notice should be given. The full fee will be charged if cancellation is under 48 hours. Please note that all cancellations must be communicated between you and your instructor or vice versa. QMH Driving School is unable to pass on cancellation information.
13.2 Cancelling of lessons must be arranged through an SMS text or email to your Instructor in order to organise the next appointment more easily.
13.3 If your instructor cancels the lesson due to either illness, mechanical fault or unforeseen circumstances outwit your instructor’s control, another time will be offered either for the same day or for an alternative date and time, suitable to both parties, within the same week. If no alternative date and time within the same week can be arranged, a lesson will be arranged for the following week.
13.4 Your instructor cannot be held responsible for cancelled lessons due to bad weather.
13.5 In the event that you do not show up for the lesson, your instructor will wait for 15 minutes before leaving. The lesson will then be presumed cancelled and you must pay for the lesson.
14. PRACTICAL DRIVING TESTS
14.1 When attending a driving test, a minimum of three hours will be required which includes one hour drive prior to the test, one hour for the test, and one hour to get the candidate home and, therefore, a fixed fee will be applied to accommodate the use of the learner vehicle for the test.
14.2 Hire a car for the practical driving test fee is £130.00 for a manual car and £130.00 for an automatic car. The hire of the car on test day price is correct as of January 2022. Although we strive to remain competitive with our pricing, QMH Driving School reserve the right to alter the pricing structure without prior notice. subsequent hire of a car for a practical, a fee will be charged. Any outstanding pre-paid will be honoured at the original price paid.
14.3 The hire of the car on test day price does not include an extended driving test.
14.4 Your instructor is not responsible for tests canceled by the DVSA due to strike action, road conditions in bad weather, or staff sickness. Hiring a car for the practical test, a fee will still be chargeable.. Your instructor will advise you as to whether, and how, to claim compensation from the DVSA.
14.5 If you fail to take regular lessons between a test being booked and the test date, your instructor reserves the right to withdraw the use of the learner vehicle for driving test purposes.
14.6 In the unlikely event that you book your own driving test, your instructor must be notified of the date and time of any tests at least 14 days prior to the test date to ensure that your instructor’s vehicle is available for the test and to avoid the risk of double bookings.
14.7 Your instructor reserves the right to withdraw the use of the learner vehicle for driving tests if your instructor deems that you are not yet ready for the test and it would, therefore, be unsafe for you, the examiner or other road users if you were to sit your test at that time and QMH Driving School does not accept any responsibility for this decision.
15. YOUR PHOTOGRAPH
15.1 Your instructor will ask you for a photograph or video when you have passed your driving test. By agreeing to this, you are allowing us to use the photograph in our testimonials section and possibly on social media sites and elsewhere as promotional material.
16. FEEDBACK
16.1 You will be given the opportunity to complete a feedback form in relation to the driving course. This feedback will contain questions relating to the service provided by your instructor. This feedback will be recorded and used to measure the effectiveness of the driving course and the performance of your instructor. Your instructor will be given feedback on performance at regular intervals.
17. COMPLAINTS PROCEDURE
17.1 In the unlikely event of a complaint or dispute the guidelines of the Code of Conduct will be adhered to at: https://www.gov.uk/guidance/adi-voluntary-code-of-practic.
17.2 In the rare event of any problem arising, you should resolve this with your instructor immediately. We recommend no further lessons are taken until the matter is resolved.

17.4 We aim to resolve complaints within 5 working days, in some instances we may ask for the complaint to be sent in writing, any requests sent in writing we will try to resolve within 28 working days.
18. PRIVACY
18.1 We are committed to protecting your privacy. We will only use the information that we collect about you lawfully – in accordance with the Data Protection act 1998
18..2 Any personal information which we hold to process your booking will be held securely in accordance with the law, and will not be sold or passed on to a third party.
19. LEGAL LIABILITY
19.1 Your instructor will make every effort to train you to the highest standard but can in no way be held liable for any errors you may make before, during and after passing a practical driving test.
20. YOUR RIGHTS
20.1 These conditions do not affect any protection you have under consumer legislation.
20.2 We reserve the right to change or alter any of the terms and conditions without notice but will endeavor to inform pupils of any changes as soon as possible.
